Introduction

In this document, “Company”, “we” or “us” refer to End Insomnia LLC, a company incorporated in Bulgaria, reg. No. 207100763, with registered address in Bulgaria: Varna, “Mladost” District, 12 Atanas Hristov str., first floor, ap. 1, represented by Ivaylo Kalburdzhiev in his capacity of managing director and legal representative. We respect your privacy and are committed to protecting it through our compliance with this policy and the privacy notice, which will be provided to you separately. This policy describes the types of information we may collect from you or that you may provide when you visit the website http://endinsomnia.com/ and ordering/purchasing a book or other goods, that are sold, including any content, offered on or through http://endinsomnia.com/ (the “Website”) and our practices for collecting, using, maintaining, protecting, and disclosing that information.

This policy applies to the information we collect when you are conducting purchases through the Website or through other means available (if any), jointly referred to as “Services”.Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, you must not access or use the Website for the use/order of Services. This policy may change from time to time (see “Changes to Our Privacy Policy” section below). You will be notified at least one month before such changes enter into force. Your continued use of the Website and/or Services after entry into force of the changes is deemed to be acceptance of those changes. You will also be provided with separate privacy notices in accordance with art. 13 of Regulation 2016/679 (“GDPR”). 



Children Under the Age of 18

The Website and the Services are not intended for children under 18 years of age. No one under the age of 18 may provide any personal information to or on the Website or for the use of the Services. We do not knowingly collect personal information from children under 18. If you are under 18, do not use or provide any information on this Website or through any of its features, register on the Website, make any purchases through the Website, use any of the interactive or public comment features of the Website, or provide any information about yourself to us, including your name, address, telephone number, email address, or any user name you may use. If we learn we have collected or received personal information from a child under 18 years of age, we will delete that information.

We do not collect personal information automatically, but we may tie this information to personal information about you that we collect from other sources or that you provide to us.

How We Use Your Information

To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of the Company’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by the Company about the Website users is among the assets transferred.

• With your consent.

We may also disclose your personal information:

We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information: 

Tracking Technologies and Advertising. You may set your browser to refuse all or some browser cookies or to alert you when cookies are being sent or use the cookie management tool that we have made available on the Website. If you disable or refuse cookies, please note that some parts of the Website may be inaccessible or not function properly.
Promotional Offers from the Company. If you do not wish to have your email address used by the Company to promote our own or third parties’ products or services, you may opt-out from promotional emails via the link provided in any promotional email sent to you by the Company. You may also opt-out at any time by sending us an email requesting us to remove you from our direct marketing list.      



Your rights

You may review and change your personal information by logging into your account on the Website. You may also send us an email at support@endinsomnia.com to request access to, correct, or delete any personal information that you have provided to us. Please note that we may request additional information in order to verify your identity prior to exercising your rights. You will receive a response to your request within up to 30 days as of the later between: (i) Receipt of your request; or (ii) Verification of your identity. You are also entitled to object against processing based on our legitimate interest – in this case we will conduct a balancing test and we will seize any future processing if your rights and freedoms outweigh our interests. You are also entitled to object against automated decision making for matters that may have legal effect on you – for avoidance of doubt, we do not use such automated decision making. If you request deletion of your data, you may no longer be able to fully benefit from our services- depending on the relevant deletion request, we will provide you with information on the potential impact on the accessibility of our services. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

You are entitled to lodge a complaint with a supervisory authority. The supervisory authority for lawful personal data processing in Republic of Bulgaria is the Bulgarian Commission for Personal Data Protection (www.cpdp.bg). 



Your California Privacy Rights

If you are a California resident, California law may provide you with additional rights regarding our use of your personal information.



Data Security

We make commercially reasonable efforts to protect the information you provide to us by using physical and electronic safeguards designed to protect the integrity and security of personal information – a.k.a Technical and Organizational Measures. We take all commercially reasonable precautions to protect the information you provide to us from loss, misuse, unauthorized access, disclosure, alteration, and destruction. However, as no electronic transmission or storage of information is entirely secure, we make no guarantees as to the security or privacy of the information you provide to us.

The safety and security of your information also depend on you. Where we have given you (or where you have chosen) a password for access to certain parts of the Website, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. 

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to the Website. Any transmission of personal information is at your own risk. We are not responsible for the circumvention of any privacy settings or security measures contained on the Website.

We take measures to retain your information for a period of time that is no longer than necessary to fulfill the purposes outlined in this privacy policy, unless a longer retention period is required or permitted by law. When determining the retention period, we take into account various criteria, such as the type of services provided to you, the nature and length of our relationship with you, the impact on the services we provide to you if we delete some or all of the information you provide to us, the mandatory retention periods provided by law and the relevant statute of limitations.

Your personal data will be processed for the following purposes:

1. Processing your orders, made through the website http://endinsomnia.com/ or via other communication means;

2. Delivery of your orders through the website http://endinsomnia.com/

3. For direct marketing purposes - sending out our newsletter and other marketing materials;

4. For statutory reporting (e.g. tax reporting);

5. For processing warranty claims and other claims in case any dispute arises in relation to your order.

Your personal data shall be processed on various legal grounds, depending on the relevant purpose for processing, namely:

3. For direct marketing purposes – your personal data will be processed based on your explicit, informed, prior and freely given consent as per art. 6, paragraph 1, “a” of the GDPR

4. For statutory reportings (e.g. tax reportings) – your personal data may be processed based on art. 6, paragraph 1, “c” of the GDPR - for compliance with a legal obligation to which the controller is subject to. 

5. If your data is processed for our protection from legal claims – such processing will be based on our legitimate interest to protect our company as per art. 6, paragraph 1, “f” of the GDPR.

Your data will be disclosed to licensed courier companies for the purposes of delivery of your order.

Public bodies are entitled to request and receive information, which may include your personal data (e.g. invoices in case of a tax audit or VAT reports). In this case we may disclose such information only after we ensure that the respective public body has observed the applicable procedures and has issued a lawful request.

Your data may be disclosed to our data processors (if any) only after sufficient safeguards have been implemented (including agreements).

Data for previous orders will be stored for five years as of the date of confirmation of the order.

The data for your account will be stored until your account has been deleted – upon your request or due to breach of our rules.

In case your personal data has been included in an invoice or other financial document, this data (along with the respective accountancy document) shall be stored for 10 years, considered as of 01 January of the year following the year in which the document has been issued in accordance with art. 12 of the Bulgarian Accountancy Act.

Your personal data regarding receipt of our newsletter shall be stored until withdrawal of your consent and/or until you unsubscribe from the newsletter list.

You have the right to request access to and rectification or erasure of your personal data or restriction of processing concerning you or to object to processing as well as the right to data portability.

If we have collected and processed your Personal Information with your consent, then you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect the processing of your Personal Information conducted in reliance on lawful processing grounds other than consent.

Where your personal data is processed based on our legitimate interests, you’re entitled to object against such processing. In this case we will conduct a balancing test and will seize any further processing in case your rights and freedoms outweigh our interests.

You may exercise your rights via electronic communication – by sending us an email.

You are entitled to lodge a complaint with a supervisory authority. The supervisory authority for lawful personal data processing in Republic of Bulgaria is the Bulgarian Commission for Personal Data Protection (www.cpdp.bg)

If you do not provide us your data, we shall not be in a position to process your order. 

Please note that provision of your consent for the marketing purposes is not mandatory and you may complete your registration without having to agree on this.

In case some of your data is transferred to a country outside the European Union or the European Economic Area, we shall ensure that such transfer is based on standard contractual clauses approved by the European Commission or other legal grounds

You shall not be subject to any automated decision-making whatsoever.
